Understanding the Legal Documentation Needed for an Austrian Wedding 

A Comprehensive Guide for Couples from the UK and USA

Planning a destination wedding in Salzburg, Austria, offers the allure of romance and scenic beauty. However, navigating the legalities can seem daunting. To help couples from the UK and USA, this blog outlines the essential legal documentation and steps required to make your Austrian wedding legally binding.

Austria recognizes civil ceremonies as the only legally binding form of marriage. These civil ceremonies can take place at all of my venues I have on my website, however the local registry office only conduct weddings on Tuesday’s Friday’s and Saturdays. These ceremonies are conducted by a registrar.

Blessings and Symbolic ceremonies can take place any day at any venue, but the legal part would be completed in your country of residence.  To complete the legal part here it is a little more complicated and you are restricted on days but all completed through  the local registry office (Standesamt).   Just to reiterate Religious or symbolic ceremonies can be arranged, but they do not carry legal validity unless preceded by a civil marriage.

Essential Documents (for both partners):

1. A copy of the Passport (A valid passport is necessary as proof of identity.)

2. Birth Certificate: with an Apostille. (Think of it as, an Apostille is a special certificate that proves a document is legal and authentic in another country)

3. Proof of Single Status

   – UK Certificate of No Impediment (CNI), issued by your local council, with an Apostille (not older than 6 months

   – USA: Single Status Affidavit, notarized and apostilled in the U.S.

4. Divorce Decree or Death Certificate (if applicable): If previously married, provide proof of divorce or the death certificate of the former spouse.  With an Apostille

5. Proof of Residency: gas, energy or telephone bill

6. Certified copy of an entry, marriage – marriage certificate (of all weddings), with an Apostille

Apostille Stamp Legalization of your documents via apostille may be required, depending on your country.

   – UK Apostilles are issued by the UK Foreign, Commonwealth & Development Office.

   – USA Obtain from your Secretary of State’s office.

It is crucial that our company contact the Standesamt in Salzburg as early as possible on your behalf so plan ahead early to confirm specific requirements and timelines, as these may vary slightly between offices. When writing this blog in November 2024, the city of Salzburg are booked up for new weddings until May of 2025.

Some general guidelines include:

– Documents should be submitted 6-12 weeks before the wedding date

– Ensure that documents are no older than 6 months from the issue date.
